These Terms and Conditions ("Terms") govern your use of the B'dayBuzz platform operated by B'dayBuzz Ltd ("Company", "we", "us", "our"), accessible at www.birthdaybuz.com. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 18 years old and a resident of Nigeria to use B'dayBuzz. By using the platform, you represent and warrant that you meet these requirements. We reserve the right to terminate accounts of users who do not meet eligibility requirements.

2. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and up-to-date information during registration.
• You may not create accounts for others without their explicit consent.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Permitted Use

You agree to use B'dayBuzz only for lawful purposes and in accordance with these Terms. You must not:

• Use the platform to harass, abuse or harm other users or merchants.
• Attempt to gain unauthorised access to any part of the platform or its systems.
• Upload viruses, malware or any other malicious code.
• Engage in any activity that disrupts or interferes with the platform's operation.
• Misrepresent your identity or affiliation with any person or organisation.
• Use the platform for any commercial purpose other than as expressly permitted (e.g., operating a store).

4. Gift Shop & Orders

When you place an order through the B'dayBuzz gift shop:

• You are entering into a transaction with the merchant, not with B'dayBuzz directly.
• B'dayBuzz acts as an intermediary marketplace facilitating the connection between buyers and merchants.
• All prices are listed and include applicable fees unless stated otherwise.
• Orders are confirmed once payment is successfully processed.
• Delivery timelines are provided by merchants and are estimates only.

5. Refunds & Returns

We operate a buyer protection policy to ensure fair outcomes:

• Refund requests must be made within 24 hours of receiving a damaged, defective, or incorrect item.
• Refunds are not available for correctly delivered items that you simply change your mind about.
• To request a refund, contact us at support@bdaybuzz.ng with your order number and photos of the issue.
• Approved refunds are processed within 5–10 business days back to the original payment method.
• B'dayBuzz reserves the right to make the final determination on refund eligibility.

6. Merchant Terms

If you register as a merchant on B'dayBuzz, you additionally agree to:

• Provide accurate business information and maintain valid documentation.
• Only list products that you have the right to sell and that comply with law.
• Fulfil orders accurately, on time and in accordance with the descriptions provided.
• Accept a 10% commission on all successful sales, deducted before payout.
• Not engage in price gouging, misleading descriptions or counterfeit goods.
• Maintain professional standards in all customer interactions.

B'dayBuzz reserves the right to suspend or permanently remove merchants who violate these standards, without notice and without refund of any commissions already earned.

7. Payments

All payments on the platform are processed by Paystack, a third-party payment processor. By making a payment, you also agree to Paystack's terms of service. B'dayBuzz does not store your card details. In the event of a payment dispute, please contact us and we will liaise with Paystack on your behalf.

8. Intellectual Property

All content on the B'dayBuzz platform — including logos, text, graphics, software and design — is the property of B'dayBuzz Ltd or its licensors and is protected by Nigerian and international intellectual property laws. You may not reproduce, distribute or create derivative works from our content without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, B'dayBuzz shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the platform, including but not limited to loss of profit, loss of data, or failure of delivery. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend and hold harmless B'dayBuzz Ltd, its officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses (including legal fees) arising from your violation of these Terms, your use of the platform, or your infringement of any third-party rights.

11. Termination

You must be at least 13 years old to use B'dayBuzz. By using the platform, you represent and warrant that you meet these requirements. We reserve the right to suspend or terminate your access to the platform at any time, with or without cause and with or without notice, including for violation of these Terms. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will do so.

12. Cookies Policy

B'dayBuzz uses cookies to enhance your experience. Essential cookies are required for the platform to function. Analytics and preference cookies can be controlled via your browser settings. By using our platform, you consent to our use of cookies as described in our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or platform notice. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
